I've read Ian's post in Ride Outs about the MCN article which says how the leader of a rideout can be held responsible for the group's speed - here's the article Crock of S**T

Absolutely unbelievable!!!!

I thought I'd post a separate thread to highlight this ruling. In case you're not aware Crown Court rulings can be used to guide judges in subsequent cases. Not sure if this means that PFs will be able to use the CC ruling?

Yes you are correct it is a crock of sh** . We as riders should be seen as individuals , they cant find fault with the innocent party ( or can they ? ) .

By the way did you notice the name of the author ? Not me honest !

Crown Court does not have same effect in Scotland. Think this ruling would have problems to be applied - any aggravation in Scottish law must be backed by legislation e.g. racial assault.

I had a feeling this might be the case. It's being discussed on another forum which covers all aspects of motoring law both in England and Scotland.

Still good to know if we're ever travelling south of the Border - e.g en route to Newcastle for the ferry or down to IOM for the TT etc.

Was watching Panorama last night, program called Lethal Enterprise. A report on the little known joint enterprise law, by which anyone caught up in a serious incident could face the same sentence as a boot, knife or gun wielder. I think this leads us to the speeding offence where the group leader could be prosecuted as well as the speeding rider.

I don't thing this affects us - anyway all the more reason to ensure club runs are done within law.

Some have joked about speed of runs - now you know why as a committee we have advocated proper riding in groups, no overtaking etc. There was always a liability issue in civil law.
